Florida Criminal Code 782.07 defines manslaughter as the killing of another person by the act, procurement or culpable negligence of another without lawful justification and in a manner not constituting murder or excusable homicide.

Manslaughter is a lesser charge than first-degree or second-degree murder because it does not involve a killing that was committed with the required intent for a murder charge. A person may be convicted of manslaughter even if he or she did not intend to kill another person.

Manslaughter and Aggravated Manslaughter

Manslaughter is typically a second-degree felony, punishable by up to 15 years in prison. Manslaughter involving the killing of a person who is 65 or older, under the age of 18, a disabled adult, officer, firefighter or emergency medical technician constitutes aggravated manslaughter, a first-degree felony, punishable by up to 30 years in prison.
