What Is Pretrial Diversion?

If you are a first-time offender or have a limited criminal history, you may be eligible for deferred prosecution, sometimes referred to as a pretrial diversion program. As part of the program, you must remain law abiding for a period of time and follow specific orders of the court. If you do so successfully, you may avoid a criminal conviction.

The state of Florida has diversion programs for certain drug offenses, first time DUIs and other nonviolent felonies. Individual counties offer diversion programs for misdemeanor offenses.

Florida law establishes that in order to be accepted into a pretrial intervention program, the defendant must:

  • Consult with an attorney
  • Voluntarily agrees to participate in the program
  • Knowingly and intelligently waives the right to speedy trial for the duration of the program
  • Has the consent of the victim, the state, and the judge
