  • Is over 2,000 pounds but less than 10,000 pounds or over 10,000 plants, that person will be sentenced to a mandatory minimum of 7 years in prison and will be forced to pay a fine of $50,000.
  • Is over 10,000 pounds or possesses 10,000 plants or more, that person will be sentenced to a mandatory minimum of 15 calendar years in prison and forced to pay a fine of $200,000.

Cocaine Trafficking

  • Any person, who knowingly sells, purchases, manufactures, delivers, or brings into the state of Florida, or is knowingly and in actual or constructive possession of 28 grams or more of cocaine, or a mixture containing cocaine, but less than 150 kilograms of cocaine, commits a first degree felony. If the quantity involved:
    • Is 28 grams or more, but less than 200 grams, that person will be sentenced to a mandatory minimum of 3 years in prison and forced to pay a $50,000 fine.
    • Is 200 grams or more, but less than 400 grams, that person will be sentenced to a mandatory minimum of 7 years in prison and forced to pay a $100,000 fine.
    • Is 400 grams or more, but less than 150 kilograms, that person will be sentenced to a mandatory minimum of 15 calendar years in prison and will be forced to pay a $250,000 fine.
  • Any person, who knowingly sells, purchases, manufactures, delivers, or brings into the state of Florida, or is knowingly and in actual or constructive possession of 150 kilograms or more of cocaine, or a mixture containing cocaine, commits a first degree felony and shall be punished to life imprisonment.

  • Any person, who knowingly sells, purchases, manufactures, delivers, or brings into the state Florida, or is knowingly and in actual or constructive possession of 4 grams but less than 30 grams of any morphine, opium, oxycodone, hydrocodone, hydromorpine, or any salt derivative, isomer, or heroin, or a mixture containing any such substance, commits a first-degree felony. If the quantity involved:
    • Is 4 grams or more, but less than 14 grams, that person will be sentenced to a mandatory minimum of 3 years in prison and will be forced to pay a $50,000 fine.
    • Is 14 grams or more, but less than 28 grams, that person will be sentenced to a mandatory minimum of 15 years in prison and will be forced to pay a $100,000 fine.
    • Is 28 grams or more, but less than 30 kilograms, that person will be sentenced to a mandatory minimum of 25 calendar years in prison and will be forced to pay a $500,000 fine.
  • Any person, who knowingly sells, purchases, manufactures, delivers, or brings into this state, or is knowingly and in actual or constructive possession of, 30 kilograms or more of any morphine, opium, oxycodone, hydrocodone, hydromorpine, or any salt derivative, isomer, or heroin, or a mixture containing any such substance, commits a first-degree felony. Any person who has already been convicted of a first-degree felony for trafficking illegal dugs will be sentenced to life in prison.
  • Any person, who knowingly sells, purchases, manufactures, delivers, or brings into this state, or is knowingly and in actual or constructive possession of, 60 kilograms or more of any morphine, opium, oxycodone, hydrocodone, hydromorpine, or any salt derivative, isomer, or heroin, or a mixture containing any such substance, commits a capital felony.
