ERISA

ERISA (the "Employee Retirement Income Security Act") is a federal law that governs health and retirement plans for non-governmental employees. ERISA imposes minimal standards upon individuals that manage ERISA qualifying plans. COBRA (the "Consolidated Omnibus Budget Reconciliation Act") is a subsection of the ERISA law. COBRA provides for continuation of health care coverage (for a limited period of time) for employees and beneficiaries after they stop working. COBRA also imposes a notice requirement that every employee receive notice of their rights under COBRA.

Individuals that have or have had retirement or health plans through their employers should speak with an attorney to ensure that a breach of ERISA has not occurred and that the employee is receiving all his rights under the law.
