Fleeing and Eluding: Definition Under FL Law

"Fleeing and Eluding" is defined under Florida Statute 316.1935 as having the following elements:

  • The defendant was driving a vehicle on a Florida street or highway;
  • A Florida law enforcement officer ordered the defendant to stop or remain stopped and
  • The defendant, knowing that he or she had been ordered to stop by the law enforcement officer either
    • willfully refused or failed to stop the vehicle, or
    • having stopped the vehicle, willfully fled in vehicle in an attempt to elude the officer.

Simple fleeing and eluding is a third-degree felony in Florida, subject to a prison sentence of up to five years. The charge and penalties can be aggravated if:

  • The police car had its lights and siren on
  • You drive in a reckless manner while fleeing
  • You caused an accident resulting in bodily injury or wrongful death

If you fled a law enforcement officer with lights and siren on, while driving in a reckless manner and caused an accident resulting in injury or death, you could be charged with a first-degree felony, punishable by up to 30 years in prison.
