  • Any photographic or video images of a child under the age of eighteen which shows the nude breast, genitalia or buttocks of a child, or shows the child performing or participating in a sexual act, may constitute child pornography. The transmission of these images to any other person is also illegal. Each individual photograph or video may constitute a separate criminal charge. Therefore, a person who may have twelve such images saved on a computer can face twelve charges of possession of child pornography. Each count carries a sentence of up to five years in prison, so having twelve images exposes a person to up to sixty years of incarceration.

  • What does it mean to get charged with child pornography on your computer?
  • Having child pornography on your computer means viewing or saving any image, photo or video which depicts a person under eighteen performing or participating in a sexual act. It also includes nude images of a minor showing their genitalia or buttocks.  Each individual image, photograph or video constitutes a separate charge. Therefore a person with seven such photos and three videos could face up to ten counts of Possession of Child Pornography, each one carrying a maximum sentence of up to five years imprisonment.

  • May I be found guilty if I accidentally receiving child pornography?
  • Any possession, accidental or otherwise, of child pornography could subject a person to a criminal charge.
