Orlando ERISA Attorney
What Is ERISA?
“ERISA”, or the Employee Retirement Income Security Act (1974) is a federal law that governs health and retirement plans for non-governmental employees. ERISA imposes minimal standards upon individuals that manage ERISA qualifying plans. ERISA requires that participants be provided with plan information to include the plan’s features, funding, fiduciary responsibilities, grievance procedure, and appeals process. ERISA provides plan participants with the right to sue for benefits and breach of fiduciary duty.
The legal standards set forth by ERISA in regards to employee pension, health, disability, life, and investment insurance policies, change continuously. This makes it very difficult for employers to understand and keep up with this law. Our experienced ERISA attorneys in Orlando, FL make this a priority! Call us today!
The Consolidated Omnibus Budget Reconciliation Act (“COBRA”) is a subsection of the ERISA law. COBRA provides for continuation of health care coverage (for a limited period of time) for employees and beneficiaries after they stop working. COBRA also imposes a notice requirement that every employee receive notice of their rights under COBRA.
The Health Insurance Portability and Accountability Act (“HIPPA”) is another subsection of ERISA. HIPPA provides protections for employees and family members that have preexisting medical conditions or might otherwise suffer discrimination in health coverage based on factors related to health.
Individuals that have or have had retirement or health plans through their employers should speak with an attorney to ensure that a breach of ERISA has not occurred and that the employee is receiving all his rights under the law. LaBar Adams helps individuals when they have not received proper notice of their COBRA rights under ERISA, when they have improperly been denied their health care under COBRA, when the minimal standard of care imposed upon managers of ERISA qualifying plans have been violated, and when their rights under ERISA have been violated. LaBar Adams recovers damages for clients when their current or previous employer has violated their rights under ERISA.
